Japanese high court denies redress to Chinese forced laborers
FUKUOKA, May 24, Kyodo - (part of the news)
A Japanese high court denied redress Monday to 15 Chinese men forced to work
in Japanese coal mines during World War II in the first-ever ruling at the
high court level on a series of lawsuits former Chinese forced laborers have
filed across Japan.
But the Fukuoka High Court acknowledged that the state and Mitsui Mining Co.
shared joint liability for bringing the men from China to Japan and forcing
them to work in the mines.
The court rejected the state's argument that it enjoys immunity from
liability for damages done by the exercise of state power under Japan's
former Constitution.
The court dismissed the plaintiffs' demand for compensation on the grounds
that the statute of limitations has expired on the case.
