Legislation and Litigation in Records Management
19th & 20th February 2004
Venue: The Kilkenny Ormonde Hotel, Kilkenny, Ireland
The law and fears of possible litigation feature largely in decisions to
retain records.
But how informed are you about the implications of legislation when it comes
to your records? Are you keeping the right records for the right length of
time? Are your records in the right format?
This conference is devoted to legislation and how it impacts on
recordkeeping, details some of the legislation that impacts directly on
recordkeeping practices and provides advice and guidance for those who have
been given the responsibility of providing their organisation with authentic
and reliable records to meet legal obligations. The legislation under
discussion is EU legislation or legislation enacted in a similar form
throughout England, Scotland, Wales and Ireland.
The aims of the conference are:
* To understand how legislation impacts on recordkeeping
* To understand the challenges presented by legislation and litigation
* To learn from the experiences of those who implement or investigate
how organisations meet legal requirements
* To learn how to identify retention requirements in legislation
* To discuss the implications of retention requirements and how to
carry out a risk assessment of your recordkeeping practices
Programme features
The speakers come from the archival, records management and legal
professions and also from organisations charged with investigating
compliance with legislation, offering their different perspectives on
recordkeeping to meet legislative requirements.
In addition to the speakers, workshops will be held to allow delegates to
investigate the following legislation:
* Organisation of the Working Time Act
* Health and Safety Acts
* Audit and EU Audit
* Company Law
Delegates will work with a facilitator to determine:
* what records are required to prove compliance with the
legislation?
* are new records or new ways of creating records required to
meet the obligations of the legislation?
* how long should records be kept?
* what are the storage implications and other cost factors in
complying with the legislation?
* what issues arise if the records are held electronically?
Each facilitator will then report back to the conference and the conclusions
and issues raised by the workshops will be made available on the website of
the Society of Archivists www.archives.org.uk <http://www.archives.org.uk>
