I am sure and certain you would prefer to ignore these issues but I am
afraid that as Chair of the Society, you have a legal obligation to address
them.
In your reply last evening, you wrote: “The articles were changed at the
AGM in 2004 and 2003 by the usual process and all members could vote by
post or proxy or in person.”
If I am not mistaken the last time the Articles were changed in relation to
membership was in 2002 where, in section (d)(i) [He shall have successfully
completed a degree or diploma course in Podiatry at a School of Chiropody
or Podiatry recognised by the Council, or have passed such examinations as
the Council may from time to time
prescribe or approve.] the passage was amended from ‘ recognised by the
Council and have passed such examinations as the Council may from time to
time prescribe or approve. In other words, ‘or’ substituted ‘and’.
As I understand it, this gave some flexibility in membership eligibility to
allow practitioners from independent schools access to the Society
PROVIDING they first sat an examination set or prescribed by Council.
This morning I have been passed a copy of the letter you sent to the
Accredited Staff Side Representatives (ASSR’s), which was also published in
the Journal (Podiatry Now) this month, in which you state categorically
that membership eligibility has been changed.
But as far as I can tell, the Articles of Association have not been
adjusted accordingly and in that regard you are in breach of your legal
obligations to membership who must receive prior notification and grant
consent before any amendments can be made. I should not have to point out
the ramifications of such a position, were the foregoing to be an accurate
state of affairs.
Could you please forward to me copies of the Society’s Annual Report for
2001, 2002, 2003 and 2004 please, along with the Articles of Association,
notating where amendments have been made in relation to motions passed by
Council. Your Chief Executive has my address.
