It is a while since I answered any queries here so I thought I better start
again!
There is no requirement whatsoever for you to have a consent form signed by
the employee to enable you to provide a report to a referrer following an OH
consultation, as long as you are purely acting in an OH capacity and not as
a treating practitioner. Where you are involved in the treatment of an
individual then the Access to Medical Reports Act would apply.
Also, in respect of OH advice, you are not providing confidential medical
information, purely functional capability advice. Where medical
confidential information is being given, this should indeed only be with the
individual's informed consent, in line with the Access to Medical Reports
Act.
It is of course good practice for the employee to be advised by the referrer
at the time of referral to OH, what the purpose of the consultation is.
Ideally they will have had sight of the referral form. On your part, it is
of course important at the start of the consultation you explain it's
purpose, the role of OH and confirm medical confidentiality.
