This rather depends on to what extent the new product relies on material
from the original and whether you have permission from the original creator
to use it.
For instance if I take a tutorial for MS Word 6 and update it to cover Word
2000, I could only claim copyright on my modifications not on the whole
item. Furthermore, if I did not have the originators permission to update
their tutorial, I could be prosecuted for infringing their copyright and be
made to remove all items from the original tutorial rendering mine useless.
Jisc legal information service can give you more information on this.
It was to stop such claims that the Public Domain License was devised. This
expressly forbids anyone to make commercial gain simply by modifying or
repurposing a product subject to a PDL agreement. It works, Linux is the
living proof (Inspite of SCO claims to the contrary).
So lets all put our work in the public domain. I'm off to catch the next

I've been following this discussion with interest and coming back
refreshed after Easter looked more fully into the links.
In one of the reports on X4L project from staffordshire university the
dreaded notion of copyright was raised. With all this sharing has any
decision/compromise been reached about who owns what. If we re-purpose
something do we automatically have copyright on the new product?
I'd be interested if anyone can offer a solution.
