I've been charged under Breach of Peace; Section 5; Causing alarm and distress against the Customer Service staff at East Riding of Yorkshire Council, Anlaby for making a complaint about my careplan not being implemented.
The Crown Prosecution(Humber) have dropped the offence down from Protection of Harassment charge to Section 5.
So, now that people in the council feel alarmed and distressed by me being a disabled person with Aspergers Syndrome and they are discriminating against me due to their discriminatory attitude and ignorance and lack of disability equality training on autistic spectrum disorders and SpLd's . This will be my defence and I'm pleading 'not-guilty'.
They could not go through with charging me tonight because they was trying to provide me with an 'appropriate adult' who was a social worker from East Riding of Yorkshire Council. The same Council who is taken me to court. I would not accept this social worker as my appropriate adult and I don't know what they was doing offering me this person.
I had a go at my solicitor because he would have let it go-ahead if I would not have got angry and said I did not want this social worker near me and he was causing me great distress and there was a conflict of interest when it was the East Riding of Yorkshire Council who was taken me to court.
I feel that my solicitor should have not have allowed the Humberside Police to use a Social worker from the East Riding of Yorkshire Council as my appropriate adult, due to this 'conflict of interest'.
I'm taken civil action against this Council and other local Health NHS Trusts for failure of duty of care ( failure and delays in assessment of my needs and implementation of my careplan(NHS and Community Care Act, professional negligence and also clinical negligence( misdiagnosis and delays in diagnosis) when I was arrested.
I felt under duress to accept an appropriate adult from East Riding of Yorkshire Council at the time of my arrest because they could have kept me locked up for up to 24 hours before deciding to charge me or release me on bail like they did. They can't find me an independent appropriate adult who as specialist training in Autistic Spectrum Disorders.
All I can say, that my lawyer Mike Farr, Max Gold Solicitors, Hull listened to me and followed my instructions and didn't allow me to be charged without an appropriate adult which met my assessed needs, This was a first for me in a criminal matter, except for my present civil lawyer Clive Yeadon, Ridley and Hall, Huddersfield. ( Thanks Mike and Clive!).
Not like all my previous legal-advocates who have been useless and negligent throughout my lifecourse and they have all failed to act in my best interests with a duty of care. I don't trust professionals easily with my abusive and discriminatory experience and Clive and Mike can empathise with my abusive historical experience.
I've also made a complaint to the John Clifford, Advisor, Disability Right Commission for discrimination and false imprisonment and unlawful arrest against the East Riding of Yorkshire Council, Humberside Police and Crown Prosecution Service(Humber). John, at the DRC are going to write a letter for me on Monday and then I can send it to all these public authorities mentioned, then they will have 14 days to respond to justify their discriminatory behaviour towards me as a disabled person with Aspergers Syndrome and SpLds'. It took me 30 minutes to get through the DRC helpline, but I hope it's worth it.
As people who know me I've had a bad experience from the DRC in the past and I've felt unsupported and discriminated by them, but I hope this is a change in attitude and 'building-bridges', in them supporting me and others with Autistic Spectrum Disorders(Aspergers Syndrome) and SpLd's who experience abuse and discrimination by national and local public-authorities in the U.K.
