Dear all,
Public Authorities are at liberty to treat oral / telephonic requests as
sufficient to qualify as a request for information under FOIA 2000, but the
legislation does not actually require them so to do.
However, oral requests for information covered under the Environmental
Information Regulations, to be laid under FOIA s 74, are definitely valid.
Some organisations may wish to take the same approach to both types to
simplify their handling procedures, as I believe DEFRA may have done.
Presumably as so many of their requests are likely to be for environmental
information.....?
