This notice is on the Competition D-G website (under Antitrust - Other
Documents - De Minimis Notice). It is listed in a way which seems to imply
that it is applicable. I would ignore the fact that it's also in
Preparatory Docs on EUR-Lex. I can't find anything to state explicitly that
it is applicable, but the accompanying press release also seems to imply
that it is (press release IP/02/13), since it replaces the previous 1997 De
Minimis Notice.
I'm afraid I don't know anything about the applicability of Notices in
general, unfortunately. Hope the above is of some use,

Can someone clarify for me when Commission Notices come into effect - are
they valid as soon as they are published.
The Notice on agreements of minor importance which do not appreciably
restrict competition... Ref. 2001/C368/07 is still listed under
Preparatory documents on Eur-Lex. Does this mean it is not applicable yet?
