This does seem to be the norm in the NHS, however that does not mean it is
right.
I personally don't see why someone should use their annual leave entitlement
as part of a graduated RTW programme. I think the physician's explanation is
a bit misleading though. Someone may be fit enough to be at their work but
not fully fit to carry out their normal duties.
It might come down to the local policies and procedures that are in place in
the absence control strategy. One thing to consider is, if the employee did
not have any annual leave to take would a graduated RTW still be
accommodated. If so, is it fair to expect one employee to utilise their
annual leave where another would not, in effect treating them differently?
