While not wishing to confuse: Sections 2 and 7 of the Health & Safety at
Work Act 1974, as well as the relevant regulatory requirements of COSHH
Regs 2002, still apply. The impact of these regulatory requirements means
that neither the employer, nor the employee, can knowingly allow exposure
to a substance which is likely to cause harm without effective control
measures in place.
Persons who are known to be 'sensitised' to a particular substance
[colophony, say, or flour dust] or who may be atopic, should not be allowed
anywhere near those work-activities likely to give rise to such exposure.
