When you say clinical information, do you mean past medical history. In that case I will believe that this is an expectation that employers know what past medical history can affect work, or work affect/aggravate any past medical conditions, this triggers off a risk assessment to ensure that we put in place any control measures to protect the individual.
However, the information on PEQ should remain confidential within HR. At the moment all our PEQ goes to an independent medical provider, we are now reviewing why we can't open all PEQ in-house and a judgment call on what requires referral. So we will face that issues of confidentiality sometime in future, not long. It will be interesting to hear what other colleagues think!
