dear Readers:
question: what are asylees' rights to acquire and use their families'
money and other property and assets outside their country of origin? is
there a general policy attached to the international conventions or is
this determined country-by-country?
background: over the past few years, we have probably all received by
e-mail several wealth-sharing proposals from writers who claim to be
African dignitaries, cabinet officials, heirs of deposed rulers, etc.
with restricted access to large sums of money. they all seem to be
varieties of money-laundering schemes and confidence games.
putting aside whether the particularly colorful one attached below is
genuine or fraudulent, it is the first one I've received that brings up
the matter of asylees' rights to inherit and use family money or other
property that may have been transferred out of their country of origin.
is this a true statement of the situation in South Africa and/or other
countries concerning asylees' rights to family wealth, rights to engage
in enterprise, etc.? if so, do states simply confiscate the property
for their own use?

With due respect,trust and humility i write this letter to you seeking
help and assistance though it's difficult since we have not met before,i
belive that you are capable and reliable in handling this urgent
international transaction of this sort.
My name is Adullaya Hanya,the son of Mr Oseni Hanya of Kwekwe
Zimbabwe.This current war crisis against the farmers in Zimbabwe from the
support of President Robert Mugabe because on his envy and greediness to
claim all the farms for his party members and his followers, he ordered
all farmers to surrender all their farms(lands) to his party members and
his followers.
On 12 Decmber my beloved father a Kwekwe farmer, Mr Oseni Hanya was
murdered in an ambush at our farm gate at about 18:00hrs evening.My
father(Mr Oseni Hanya of blessed memory)has the biggest and best farm in
our country and because he did not Support Robert Mugabe ideas,
Upon this act of greedness Mr presidet have this to say, We are no longer
going to ask for the land, but we are going to take it without
negotiating.
"I urge farmers to drop the nonsense of fighting the land issue in the
courts, as that will make us even more angry. If the farmers cannot be
harmonious...then we will ask them to leave our country harmoniously," he
said.My father was well known to Zimbabwe's president. He was an MP for
Ian Smith's Rhodesian Front until two years after independence in 1980,
but then allied himself with the new order and was appointed to
parliament by Mr Mugabe as a non-elected MP.
He broke with the ruling party in 1994 after being accused of abusing
several women whom he "arrested" for stealing in the farm. Mr Mugabe
publicly denounced him as a racist and pledged to seize his farm.He had been
an outspoken critic of President Robert Mugabe's ruling party. Mugabe has
described the farm occupations as a justified protest against unfair land
ownership .
Mugabe order his supporters to invaded my father's best farm in Kwekwe
region, 150 kilometers (94 miles) and burnt everything in the farm in asmuch
as killing my beloved father and made away with a lot of items in my
father's farm.(On 12 Decmber,at about 18:00hrs )
Before his death, my father deposite with a Security Company in South Africa
the sum of {US$19 Million}{Nineteen Million United States Dollars only }
as family valuables.This money he intended for 2002 politics and the
opening of the new hectares of farm land in Shiselweni Village near
Umbuluzi in Swaziland which my father negosiated to buy with the help of
the Swaziland Monarch King Suboza Mswati (lll) as well as buying tractors
for the newly site which my father had made all the enquries from NEW
LONDON TRACTOR & EQUIPMENT. ROUTE 460 WEST OF LYNCHBURG LONDON before his
untimely death.
Before his untimely death that day my father have this to say,"you Adullaya
because as a father I have to tell my child that you must never expect that
there is a future for you in this country " Now the Minnister of Agrclture
Mr Joseph Made who is a strong member of the president Robert Mugabe ruling
party has for now allocated prime farms lands to all top governments, army
and Zanu-Pf officals under what he called the "Murky Commerical Settlement
Scheme".
Among the officals allocated the prime farm lands were the war
Veterans,Joseph Chinotimba,the leader and the self-stlyed commander of farm
invasions,Elliot Manyika,the youth delevopment minister,Augustine
Chihuri,the police commissioner ,Webstar Bepura ,the bindura mayor and one
of the top president Robert Mugabe's loyalist,Menard Muzariri,senior central
intelligance organisation operative and Dick Mafiosi.
Due to the pressure on me and the situation of things in the country ,after
l have been discharged from the hospital,that the will still attack me,I
decided to move to the Republic of South Africa (as all my hopes is no more
) and was declared as a political aslyum seeker where my father had
deposited the Money in the Security Company as family valuables to withdraw
it and put to use for the fact that l have no other hope.
My hopes was turn down as it is against the human right law of South Africa
for asylums seeking refugee in their country to have an account with there
banks or to have an enterprise in they country. Refugee(SECTION 22 ACT OF
THE REFUGEE ACT NO 13 OF 1998)prohibits it and failure to comply on this
is against the SECTION 37(B1 and B9) of the South African Refugee laws
financial laws(f1,fa2)
After all this l decided to seek for an advice on the best way to retrieve
this money ,my lawyer advised me that the best way is for me to contact a
forigner as oversea partner(not living in South Africa) so that you can help
me because as aslyum seekers here the human right law of the country will
not allow me as l am living here and will not allow any person that is from
or operating in the country (South Africa) So l decided to contact you so
that you can assist me to move this money out of South Africa because as
asylum seeker l am not allowed to operate any bank account within South
Africa . ...
