I too was amazed at the decision to prosecute in this case and the use by
the prosecution of Roy Meadows as an expert witness - let amazed by his
chutzpah in doing so.
There seem to be two areas where the conduct of the CPS can be
questionned:
1) what was the clear prima facie evidence that a crime had been
committed, and
2) if so, could the accused be proved to have done something BEYOND
REASONABLE DOUBT.
The response from the Lord Chancellor's office to the previous RSS
approach was disappointing, and the decision to bring the Patel case
appears to support the need for general guidance.
