Conwy Council have been issued with a "compliance notice". I think our website will explain what this is as Alaba has referred you to. But it means that the Council have 28 days to take action and report back to the CRE. If after 3 months the organisation has not in the opinion of the CRE made sufficient progress and is still not meeting one or more of its specific duties under the Act the CRE can apply to the county court for an order to obey the notice. If the court grants the order and the organisation does not keep to it then the organisation may be found in contempt of court.
You can find this information in the Code of Practice on the duty to promote race equality which can be purchased from TSO via our website.
It may be of interest to members that in advance of a compliance notice organisations are sent at least 3 letters from the CRE asking them to provide a copy of their Race Equality Scheme or respond to apparent gaps in the Scheme, so overall organisations get several opportunities and considerable time to respond before things become formal. To date numerous letters have been sent to various public sector organisations enquiring about their Scheme as a result of CRE initiated queries or following being alerted by others. It remains to be seen how many of them will respond at this stage.
