In the context of a list it is known that it is distributed to other members
of the list so that implicit permission for that has been granted, however
to make other use of the materials requires a licence, there is law on the
internet and people had better be aware that there have been succesful
prosecutions of ISP's with regard to libel on newsgruops.
The fact that the desiderata's attribution was wrongly thought to be public
domain, does not make all those copies legal, and Max Ernst would have legal
claim.
As a case in point, there are many recent translations of the Bible since
King James, they are all copyright and even there inclusion as quotes in a
church newsletter is liable to the usual law, (it states so in the
introduction to them all)
perhaps I should include a signature reserving all rights in the usual
literary format to my emails in future, because this IS what I intend, and I
am at this point explicitly asking the listowner to remove and not archive
my material.
I DO NOT FEEL SAFE ON THIS LIST.
