I seem to be over-using this mailgroup at the moment, but..
In remediating a group of residential properties the only really viable
option is the excavation and removal of the contaminated soils, at the
residents expense as Class B persons. How much re-instatement is it feasible
to include in remediation? The problem is, if the authority goes into
landscaping and replacing the gardens, would we be able to recover costs as
this isn't strictly remediation as defined by the legislation (if there was
a Class A person the residents would be able to claim compensation)?
