Dear Dr Pal and Others
I have had a medical/clinical negligence and failure of duty of care, under
the NHS and Community Care Act.
I have had a medical negligence report from Dr Shah, London, that I have
case for negligence against my Local Health Authority and Trusts and East
Riding of Yorkshite Council, Social Services Department.
I have been diagnosed with Aspergers Syndrome, Dyspraxia, ADHD and Dyslexia
by Dr Shah. It took me from 1995 until 2001 to get a proper diagnosis. I was
diagnosed in 1968(aged 5) with clumsy child syndrome(Dyspraxia), but only
came aware in 1995 when Iaccessed my medical records. I was also in an
adolescent Unit from 1976-78 and I was diagnosed with Specific Learning
Difficulties, but was not told, Why ?
I haveexperienced many mental health breakdowns and xperienced depression,
anxiety and Obessive Compulsive Disorder.
As i have said I have been battling with the 'public-authorities' daily
since 1995.
I have had previous solicitors who have not been able to get me legal aid.
In 1996. I went rto a firm called Harrowell/Shaftoe, York, but for 3
yearsthey could not get me legal adided. My solicitor was a Mr Simon
Holborn. He dropped my case about 1999 and I was devastated when he zsent
all my files back to my home without warning. Tis really distressed me.
I then went to Solicitor called Mr John Tippett, Sandersons, Hull. He got me
legal-aid within 3 weeks. He was a Senior Clerk, But Mr Holborn's Firm could
not get me legal aided.
Mr Tippett stayed wioth me about a year, then I was informed that he had
lost his job and Sandersonms had lost their legal aid franchise. Mr Tippett
got me a move from my previous flat, but he told me all my debts and rent
arears had been written off, but this was not true has I found out earlier
this year and I was being taken to court by the East Riding of Yorkshire
Council.
I had already been to the Social Services Independent Review Panel in
August 1997,who stated that my flat did not meet my health and social care
needs. But it took me until may 2000 to get moved. I actually was taken to
Court by my Care Manager. Connie Young for 'threatening to kill myself in my
flat by setting myself on fire.'
I had been battling with East Riding of Yorkshire Council since 1995 and I
was turened away in 1995 in Band 7 of their criteria. I had to battle to
geta care-plan, but this took me years and then I was put into band 3. But
the Health and Social Services would not send me for a proper diagnosis.
This meant I could nort get the appropriate Disability Welfare Benefits. I
was finally sent to Dr Amanda Kiurby, Dyscovery TRust, Cardiff in July 199,
but she was instructed not to give me a diagnosis. I came aware of this when
I wrote to her. She mentionee that I had elements of Asergers Syndrome,
Developmental Co-ordination Disorder(Dyspraxia)nd was Learning disabled.
I then had to fight to get
a proper diagnosis...
My case had to be referred to another local Hull firm called
Carrick, Carr and Wright. I could not believe it that the solicitor acting
in my case was Mr Holborn; the same Mr Holborn from Hallowell/Shaftoe, York.
He managed to get me an
diagnosis and also a medical negligence report from Dr Shah.
ButI cold not believe history repeated itself again and Mr Holborn lost is
job at this firm and they had lost their franchise I was informed.
I will point out that when moving from Sandersons to Carrick, Carr and
Wright there was a 3 year limitation on my case by legal aid.
Mr Holborn agreed to act on my behalf through is own firm called Holborn and
Co.
I was finding this difficult because he was accting without funding. I
continued to make complaints to the varios NHS Trusts and HEalth Authority
and my Locaal Authority, but I was coming up against a bureaucratic
nightmare.
I also made complaints to the Local Government Ombudsman and Disability
Rights Co mmision, especially has the LOcal Authority was stopping me making
complaints through the same procedure as other people in the East Riding.
I was being discrimiated against, but both the Local Government Ombudsman
and Disability Right Commision refused to upheld my complaints. I'm banned
from going into the Local Authorities Customer Service Centre's.
Mr Holborn was struggling handling my case and I few of weeks ago I agreed
to refer all my cases to Howells Solicitors, Sheffield.
I will also like to mention that I have been attending the University of
Lincoln(formely called Lincoln and Humberside)since 1991, but the have not
met my specialist learning needs.
I had made complaints, but again this has been a battle. It is 11 years
later and I have still not gained my
BA((hon). This has been another constant battle and I have had no-support
froom Social Services in meeting my educational needs.
As I said my cases where referred to Howells. Mr Barwick, Educational
negligence, Mr Price, Public and Human Rights law for Health and Community
Care, Isabel Lloyd-Jones, Medical negligence and Glynis Liewlyn, Wefare
Rights.
I will point out that Mr Holborn had sent me to Alison McDonalds Solicitors,
Hull who where Welfare Rights Solicitors, But they messed up my entlements
to income support. I made complaints, but this firm would not acept
negligence. I then made a complaint to the Office of Supervision of
Solicitors.
I amstiil awaiting a visit from a Local Concilation Officer.
As I have said I had a retainer With Howells, but They tried to stop me
making complaints to all the public-authorities and Health and Local
Government Ombudsman.
It has been over a year since Dr Shah's report, but it has taken the
'public-authorities' over a year to give me a new care plan from her
recommendations.
I have had 2 previous care-plans from Dr Kirby's referral and a after a
RE-assessment from an earlier CCA, but these plans had not been implemented
locally.
So, after years of complaining they completed their assessment finally two
weeks ago, but I was told Inwould have to move away from tghe East Riding to
them to able to met my needs.
I was not wanting to move. I told Mr Price this. I was not receiving any
care and was in constant conflict wity my care and and other social worker.
I kept ringing Mr Price to act in my best interset, but he did nothing and
told me to stop complaining to the public authorities, but I was receiving
'no-care'.
I was feling really distressed and angry, but on Friday that Mr Price would
not be acting for me, due to our arguments.
I fel disgusted and distressed and I have made complaints to his firm, but
they are not listening.
My cases are now in a mess and I have no-where to turn.
