Dear Crispin,
This is one of the ALGAO terms which I noted earlier was "confused". However, as I interpret it, it means that approval is given, but that the WSI incorporates an element of evaluation in order to finalise the exact mitigation strategy, either preservation by record or re-designed foundation. We sometimes allow this circumstance if the District Council is hell-bent on determining the application within 8 weeks and there are no other grounds for deferring the decision. Whilst planning permission can be revoked under Section 97 of the 1990 Act, it wouldn't occur in this circumstance: we would already have agreed that development could go ahead subject to mitigation, just that that mitigation needed to be sorted out further down the planning process.
Cheers,
Neil

Dear all
I've been looking at the recently posted ALGAO lists to incorporate them
into HBSMR for new installations, and wondered if anyone could clarify one
issue?
In the Consultation Final Outcome list, there is:
Term: Approved subject to evaluation
Note: The decision making body has granted consent subject to the results of
an evaluation.
This seems to imply that a planning consent could be revoked depending on
the results of an evaluation. Can anyone confirm whether this is correct and
as agreed - am I misinterpreting it?
(There are other similar entries in the table - e.g. for impact assessment).
Best wishes
Crispin
