Photographer usually retains copyright. It would be worth checking with the
publishers what the source of photos was.

As far as I am aware you must always ask permission from the publisher for
use of any their material.

Margaret: I don't know the answer to this but you could ask the CLA -
Frankie Hastings, Business Manager, ([log in to unmask]) who has
been dealing with the NHS photocopying agreement. I would be interested in
the reply as I am looking into electronic/digital copying as regards
copyright at the moment and the photographs might have been produced
digitally!!

No expert, but she should certainly start off with the book's publishers.
They may hold copyright, but there could also be other complications (eg
photos may be copyright of the photographer, protecting privacy etc).
What I am sure of is that the fact that they have been published means that
they will definitely be someone's copyright (unless the book is *very* old).

Pictures are a really difficult one. The book will not have printed the
pictures without permission from the original owner, depending on when they
were taken originally , the publisher will have needed Copyright permission
and/or permission to reproduce to items. The Publisher will also own the
copyright to the photographs in the book in the form they have been printed.
I suggest your reader would copy them at ther peril, if the copyright owner
picks upon it retrospectively she may find herself having to pay out
compensation! She should make contact with the publisher initially, address
it to the permissions editor. There is usually no charge as long as she
credits them. I attach a copy of our guide to published photographs which I
hope you will find useful.....and is of course in copyright and for your own
use!!!!!!!!

Your colleague should certainly NOT copy photos without permission from the
publisher. You might suggest that she searches the net for clip art but yes,
it would be more reliable to take her own.
