I think that the signature is required because underneath the licenses,
there is still an Act of Parliament (CDAP 1988) and a Statutory Instrument
(Copyright (Librarians and Archivists) Copying of Copyright Material
Regulations 1989 which (as far as I know) have not been repealed. I haven't
any plans to stop taking signatures because, the signature is covering a
specific legal declaration and a request, to a librarian, to supply a copy
of an article to a requester. Besides, not everything is covered by the CLA
licence and so the copyright declaration signature can still be necessary.
I tried clicking on the 'excluded works' page last week, but the link was
broken when I looked. Using the HE model, we have had an HE CLA licence for
several years and we have always taken signatures. I tend to think that the
NHS CLA licence is aimed at users doing departmental copying rather than
librarians, as this group has always been the group at most risk of
copyright infringement.
I think it is extremely important for the FAQs relating to the new licence,
to be published ASAP. I think it could cause serious problems for
librarians because we haven't had the opportunity to see the 'small print'
yet.
It's possible that Charles Oppenheim or Sandy Norman may be able to help us
with our quandary.
