My understanding is that if you take steps to ensure that no permanent copy
is retained, then this kind of store-and-forward copying of page images is
ok. It's only what happens with the smarter sort of fax machine anyway.
We hope shortly to be replacing two of our production photocopiers with
high-speed scanners, which will mean that we can deliver copies as Acrobat
(PDF) files attached to emails - quicker, cheaper and better quality. We
have to make it all work forst, though.

I would suggest getting specialist advice before actually doing this. From
my low level of knowledge, I thought this only applies to times within the
process of displaying a document in e format when a copy of it is stored,
but usually temporarily as part of the transmission process? Certainly not
to an end product copy of a full journal article (print or e), sadly.
But if you want an informed answer, suggest you email my colleagues at:

Would be great if it *was* true, of course!

Subject: Copyright directive - some good news?
I've just plodded through the Patent Office notes on this and found the
following:
Copyright in a literary work, other than a computer program or a database
... is not infringed by the making of a temporary copy which is transient
or
incidental, which is an integral and essential part of a technological
process and the sole purpose of which is to enable-
(a) a transmission of the work in a network
between third parties by an intermediary; or
(b) a lawful use of the work;
and which has no independent economic significance."
This sounds as though we will bee entitled to scan and email ILLs to each
other? Same day delivery to the user at last!
