I quite agree with your views on this Jon, but am myself concerned that such
material could not then be distributed more widely than intended and put to
uses not intended.
Given that the circumstances outlined in Ian B's e-mail are catered for,
would a copyright or restriction on use notice be any good in trying to
achieve that, or at least protect the organisation?
After all, how would a parent feel whose childs photograph taken at school
had been edited by one of the more unsavoury groups existing out there, and
then circulated widely?
In such unfortunate circumstances, what liability, if any would the school
have if they had not placed any restriction on the use of the photograph(s)?

Why, other than on a 'technical point', would you want your children not to
be videod or photographed while taking part in school activities ?
As a parent too I can see no reason to object to this and feel that it
certainly enriches their experiences being able to manipulate images on
computer/video etc. I was very happy to receive a CD containing images from
a recent trip, and my boy spent a long time flicking through them.
It would be a sad state of affairs if parents started asking for their
children to be blurred out.
I'm convinced this is not what the act was created to prevent.

I agree with you. I was staggered recently to get a letter from school
asking for consent for my daughter to take part in an event (no problem) and
saying that it was a condition of participation that photographs and video
be taken to form part of a report on the project which would also go on the
web (overseas transfer).
I didn't think that my consent was being 'freely given' in the
circumstances, and told them so in no uncertain terms. However, I didn't
withhold it, because I didn't want to embarrass or disadvantage my daughter.
Also, the form only came two days before the event (which had been planned
for months), leaving no time to raise any queries.
If the consensus is that parental consent is required, I would be grateful,
as I can use that with the school and LEA.
Obviously, where the photograph/video is an integral part of the course or
event, the considerations would be slightly different.
