Copyright Tribunal Judgement: good news for artists
The Copyright Tribunal has delivered its long-awaited judgement on the
action brought by Universities UK against the Copyright Licensing Agency
disputing the terms and cost of their photocopying licence. The Copyright
Licensing Agency represented authors and publishers in this case, and the
Design and ArtistsU Copyright Society made an intervention on behalf of
visual creators.
Universities UK asked the Tribunal to substantially reduce the fee paid by
universities for their photocopying licence. However, the Tribunal ruled
that the licence fee should be increased from #3.32 to #4.00 per full time
equivalent student per year for a period of five years.
The Tribunal also ruled that the photocopying licence should include the
right to photocopy artistic works contained within books and journals.
The Tribunal agreed with Universities UK that the photocopying licence
should include the right to produce course packs (within clearly defined
limits).
The Design and ArtistsU Copyright Society is delighted with the verdict.

that the right to copy artistic works should be included in the
photocopying licence. The increase in the royalty is good news for
rightsholders and particularly for visual creators who will start to
receive a share of this important income for the first time"
