something that has been on my mind for a while and from others i've
spoke to seems to be something others have or are mulling over....
We are all looking to publish our SMR's onto the internet ... which i think is
wonderful.
we are ourselves initially are looking at putting a few fields from the
national database onto the ADS servers.... and of cause we are trying to
download data to county SMR's sorry to those that are involved in this
there is some problems with grid refs that i've noticed and i need to get
sorted before downloading to you and this third party issue is worrying
our solicitors.
anyway the issue
SMR's are an amalgamation of disparate sources from books, os cards,
NMR, in some cases the NTSMR (the list goes on).
as i mentioned we are all looking (or have already done) placed this
information into the public remit.... now it is possible that we are
publishing information that is owned by someone else. I and our lawyers
wish to avoid.....
publishing information then having egg on face when some one says
actually thats mine and i want it off the system ... etc
or
actually i published that on my website for my database so its now my
ownership. Apparently the law does say if you publish it then you can to
some extent claim copyright.
Thus we are breathing third party licience.
Our lawyers are currently looking into an IP (intellectual Property) review
I have asked them to look into this very issue as it worries me somewhat.
I suppose in some ways this is could be resolved by:
a common access agreement between EH, NT, SMRs etc - we all have
an informal one at present
and maybe by data standards ensuring that we acknowledge that
elelments of the information are derived from other sources i.e County
SMR number, NMR, NTSMR, sources etc
has anyone else considered this? what does EH, ADS etc thing about
these issue?
