I think that this person is referring to legal incompetence, i.e.
peoplewho have been found by a court to be unable to make informed,
reasoned judgments about various aspects of their lives. In this case,
their sex lives. Not that many people make informed, reasoned judgments
aboutsuch things, but I think that the author of the quote is looking at
people who have been formally adjudged unable to do so on the basis of
some sort of disability and is trying to take a closer look at the
people who have been the subject of such decisions.
