Under recent EC legislation (Duration of Copyright and Rights in
Performances Regulations1995, S.I,1995:3297), copyright usually lasts for
70 years from the date of death of the author or photographer, not from the
date of publication. Digitisation and putting onto the Internet would,
technically, be likely to be in breach of copyright. The law requires that
you "make all reasonable efforts" (or some such wording) to ascertain who
are copyright holders and obtain permission.
