My understanding is that this exemption applies to academic research
only and the research must not be used to make a decision which
substantially affects an individual, e.g., who should get a heart transplant
or who should be made redundant.
Market research will usually involved unsolicited mailing or calling and
therefore comes under the heading of "direct marketing".
