Dear Colleagues
Last month I had some gremlins with my 'computering' and suspended
from mailbase for a few weeks.
In my absence, I hear, there was a discussion about visa nationals
apparantly being allowed to change immigration status without having
to leave the UK and then apply for entry as a student.
This afternoon I have been interviewing a Chinese National who has
secured a place on a Post Doctorate course from 1st October 2000
(yes, he has started already), as well as a studentship worth over
£9000 per annum from a British Company.
He has been in the UK for three years previously as his wife's
dependant, she completes her PhD in about six months time, he has
leave to remain as her dependant until February 2001.
Usually I would be advising my client to return to China (or similar)
and apply for entry as a student.
If anyone has any direct experience of a visa national successfully
having an FLR(S) processed outside of the rules for the same or very
similar change of status, please pass on your experience to me
